[1] We were first made aware of the independent counsel investigation through a letter our then City Commissioner, Charlie Hales, sent to the then-New York Attorney General earlier this year. We were happy to be made aware earlier this year of the ongoing investigation with our Department now being targeted. We were especially pleased to learn that the investigation appears to be in some part directed at us and that our activities within this investigation have been reported to the Attorney General — a very important step, considering the level of access given to the Attorney General in all our matters.
3rd & Main and the city attorney's office has never disclosed to D Magazine's legal team whom they referred the original letter Office of Independent Counsel had sent to them prior our obtaining copies of the documents for its review. We were told that, as per the AG's office, request was sent by D Magazine's legal team to an unrelated department/other entity (which was never identified as having anything to do with the Independent Counsel investigation). We do not know how the letter came to attention of the office Independent Counsel and when that occurred.

The above facts were disclosed during our meeting with the Independent Counsel's Office on Friday 11-16-13. Sunday 11-17- 2013 The Independent Counsel's Office informed us that we will be making our first report to an agency/office not associated with the criminal investigation of another agency, rather than to an independent agency.
